Terms of Use
Effective date: September 15, 2026
Acceptance and operator
BRAP is operated by two private individuals based in Ukraine. By downloading, registering for, accessing, or using the BRAP mobile app or related app services, you agree to these Terms of Use. If you do not agree, do not use BRAP.
Description of BRAP
BRAP is a motorcycle community service that may include rider profiles, motorcycle garages, GPS ride recording, a live rider map, ride planning and sharing, statistics and leaderboards, posts and comments, friends, groups, events and group rides, chats, map notes, SOS alerts, motorcycle places, weather information, a marketplace, and links to third-party navigation services. Features may vary by platform, country, app version, permissions, and technical availability.
Eligibility and account
To use BRAP, you agree to:
- Be at least 16 years old, or meet any higher minimum age required by the law applicable to you
- Provide accurate information and keep relevant account information reasonably up to date
- Keep your account credentials secure and not intentionally provide another person with unauthorized access to your account
- Notify us if you reasonably believe your account has been compromised
- Use BRAP only in compliance with applicable laws and these Terms
Road safety and responsible use
Your safety and compliance with traffic law always take priority over BRAP. You are solely responsible for your motorcycle, riding decisions, speed, route, equipment, and compliance with the traffic and safety laws that apply where you ride.
You must not use BRAP in a way that:
- Distracts you while riding or requires unsafe interaction with your phone
- Encourages or involves speeding, illegal racing, dangerous riding, or other traffic violations
- Uses statistics, leaderboards, achievements, routes, events, or social features as a reason to take unsafe or unlawful risks
- Endangers passengers, other road users, pedestrians, or property
Where interaction with the app is necessary, do so only when it is safe and lawful, preferably while stationary and safely parked.
GPS, maps, routes, weather and navigation
BRAP is not a certified measuring device, safety system, emergency navigation system, or driver-assistance system. GPS positions, speed, distance, routes, rider locations, map information, places, weather, event locations, and other data may be inaccurate, incomplete, delayed, unavailable, or outdated because of GPS reception, device settings, connectivity, operating-system restrictions, third-party services, user input, or other technical factors.
BRAP may hand a destination to services such as Google Maps or Waze. Route calculation, navigation instructions, road restrictions, and the suitability or safety of a route are provided or determined by those third parties and remain subject to their terms. Always follow road signs, local law, actual road conditions, and your own judgment.
Location and ride sharing
Some BRAP features process and share location. Starting a ride may enable foreground and background GPS recording and may publish your latest position according to the applicable visibility settings. Completed rides, live location, public ride links, route trimming, planned rides, events, map notes, and SOS alerts use separate visibility or processing rules. A privacy setting for one feature does not necessarily make all other location-related data private.
You are responsible for choosing appropriate sharing settings and for considering the privacy and safety consequences of publishing your current position, route, home or work area, destination, planned departure, or other location-related information.
SOS feature
BRAP SOS is a community communication feature. It is not an emergency service, emergency dispatcher, automatic crash-detection system, rescue service, or substitute for contacting local police, ambulance, fire, rescue, roadside assistance, or other appropriate emergency services.
SOS alerts and notifications depend on your device, GPS, Internet connection, permissions, authentication, BRAP servers, push providers, recipients’ devices, and other third-party infrastructure. BRAP does not guarantee that an SOS alert will be accurate, transmitted, received, displayed, noticed, or acted upon. If you are in an emergency and can safely do so, contact the appropriate local emergency service directly.
Events, groups, planned rides and map notes
Events, group rides, planned rides, group information, map notes, meeting points, times, descriptions, and similar community information may be created by users. Unless BRAP expressly states otherwise, BRAP is not the organizer, guide, tour operator, or supervisor of a user-created event or ride. Organizers and participants are responsible for verifying details, deciding whether participation is safe and lawful, and complying with local requirements.
User-supplied map notes, event information, meeting points, and other community information may be wrong, outdated, incomplete, or misleading. Do not rely on them as your sole source of safety-critical information.
Marketplace
BRAP provides a platform where users can publish motorcycle-related listings and communicate with each other. BRAP is not the seller, buyer, payment provider, escrow service, delivery provider, inspector, or party to a transaction between users unless expressly stated otherwise.
We do not guarantee a seller’s identity, ownership of an item, legality of a listing, product authenticity, condition, safety, price, availability, payment, delivery, or performance. Users are responsible for carrying out appropriate checks and complying with applicable consumer, tax, import/export, registration, and other laws. Never send money or disclose sensitive financial information unless you are satisfied that the transaction is legitimate.
User content and community rules
You retain ownership of content you create. By uploading, publishing, or sharing content through BRAP, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, and transmit that content only as reasonably necessary to operate, provide, secure, moderate, and improve BRAP and the sharing features you choose to use. This license ends when the content is deleted to the extent it is no longer reasonably necessary for those purposes, subject to technical backups, legal obligations, and content that remains as part of another user’s lawful use or conversation.
You must not publish, send, or use BRAP for content or activity that:
- Is illegal, fraudulent, threatening, abusive, harassing, hateful, discriminatory, sexually exploitative, or otherwise seriously harmful
- Infringes intellectual-property, privacy, publicity, or other rights of another person
- Impersonates another person or misrepresents your identity or authority
- Contains spam, malicious code, scams, deceptive listings, or unauthorized commercial messaging
- Attempts to manipulate, attack, scrape, overload, bypass, reverse engineer where prohibited by law, or interfere with BRAP or its security controls
- Encourages dangerous riding, illegal racing, or other unlawful conduct
BRAP may provide reporting, blocking, deletion, and administrative moderation tools. We may remove content or restrict access where reasonably necessary to enforce these Terms, comply with law, protect users, respond to valid reports, or protect the service. Blocking does not necessarily prevent every form of visibility through public links, SOS, or other independently scoped features.
Third-party services
BRAP relies on third-party services for functions such as authentication, hosting, databases, maps, weather, analytics, diagnostics, push notifications, app distribution, and external navigation. Their services may be unavailable, delayed, changed, or subject to separate terms and privacy policies. To the extent permitted by law, BRAP is not responsible for third-party services or for events outside our reasonable control.
Availability and changes to BRAP
We aim to keep BRAP available and useful, but we do not guarantee uninterrupted, error-free, or permanent availability of the app, data, notifications, maps, GPS recording, or any particular feature. We may maintain, update, add, modify, restrict, suspend, or discontinue features where reasonably necessary for product, technical, security, legal, or operational reasons.
Intellectual property
BRAP’s software, interface, branding, logos, designs, original text, databases, and other service materials are owned by the BRAP operators or their respective licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, non-exclusive, non-transferable right to use BRAP for its intended purposes and do not transfer ownership of BRAP intellectual property to you.
Account suspension and termination
You may stop using BRAP and request deletion of your account. We may restrict, suspend, or terminate access, or remove content, where reasonably necessary because of serious or repeated violations of these Terms, unlawful activity, abuse, security risks, fraud, threats to users or the service, or legal requirements. Where appropriate and reasonably possible, we may provide notice or an opportunity to correct the issue.
Disclaimers and limitation of liability
BRAP is provided on an “as is” and “as available” basis to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any mandatory consumer rights that apply to you.
To the extent permitted by law, BRAP does not guarantee and is not responsible for:
- The accuracy, completeness, availability, or timeliness of GPS, speed, distance, route, live-location, map, weather, POI, statistics, notification, or user-supplied information
- Accidents, traffic violations, fines, injuries, property damage, unsafe riding, route choices, or other consequences of a user’s riding decisions or unlawful use of BRAP
- A failure, delay, or non-receipt of an SOS alert or push notification
- User-created events, group rides, plans, map notes, listings, messages, or other user content
- Losses arising from transactions or disputes between marketplace users
- Failures or acts of third-party services, networks, devices, operating systems, GPS, map/navigation providers, or other infrastructure outside our reasonable control
International use
BRAP may be made available internationally. Availability does not mean that every feature, type of content, ride, event, marketplace activity, map location, or service is lawful, appropriate, or available in every country. You are responsible for complying with the laws and regulations that apply to you, your motorcycle, your location, your content, and your use of BRAP.
Governing law and consumer rights
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law rules, except where mandatory consumer-protection or other mandatory laws of your country of habitual residence apply and cannot lawfully be excluded. Nothing in these Terms deprives you of rights granted by mandatory law. Any dispute should first be raised with us using the contact details below so that we can try to resolve it informally. Any court jurisdiction will be determined in accordance with applicable mandatory law.
Changes to these Terms
We may update these Terms when BRAP changes or when technical, security, legal, or operational requirements change. We will publish the updated Terms and effective date and, for material changes where required, provide additional notice or request acceptance. Continued use after an update takes effect constitutes acceptance only to the extent permitted by applicable law.
